At  Nautilus Solar Energy, LLC ("NAUTILUS", "we", "us", or "our") we take your privacy and the security of your information very seriously. This Privacy Policy ("Privacy Policy" or "Policy") covers the site https://nautilussolar.com/ ("Site") and the services offered via the Site (collectively, the "Services") including how we collect, use, store and transfer information via the Site. By using the Site, you consent the privacy practices described below.

This Privacy Policy is incorporated into, and is part of, our Terms of Use available at on the Site which govern your access to the Site and your use of the Site. Unless otherwise defined herein, capitalized terms shall have the meaning assigned to such terms in the Terms of Use.

The Policy describes the types of information we gather from people visiting our Site and/or using our Services and from individual users ("you" or "users") interacting with our Site and Services and how we use, transfer, and secure such information. 1. Types of Information We Collect

We may collect two types of information from users of our Site: "Personal Information", which is information that can be used to identify you (such as name, email address, account numbers, etc.), and "Aggregate Information", which is information that cannot be used to identify you (such as frequency of visits to the Site, browser type, etc.)

1.1. Personal Information Collected

1.1.1. We collect Personal Information that you voluntarily provide to us when you use our Sites and Services. For example, you may provide us with:

  • First and Last Name
  • E-mail Address
  • Phone Number
  • Application information (if you apply for employment with us)

1.1.2. If you have an account with us, are a subscriber to one of our solar projects, apply to participate in one of our solar projects, or inquire about our Services, we and/or third parties acting on our behalf, may collect additional information, including Personal Information from you, such as:

  • Information about your utility accounts, such as your utility account numbers, usage, and login information (we only collect this information when you authorize us to do so)
  • Utility service addresses
  • Payment information: When purchasing our Services, you may provide certain payment information. This information is provided directly to our payment processing partners and is not stored at NAUTILUS.  At no time does NAUTILUS have access to your full payment card information. Payment information may include, but is not limited to: bank account numbers, account type, debit and credit card information, cardholder information including name, address, transaction card numbers, and personally identifying numbers.
  • Consumer Credit Information: We may use consumer reports to determine your eligibility to obtain certain Services by evaluating your credit history and credit information. To do this, we collect your Personal Information, which may include information such as your date of birth, , address.  We use your credit information to perform a risk analysis or determine your eligibility for certain Services, and to provide our Services. We obtain this information through a soft credit inquiry only. Prior to performing a credit check, we will provide additional disclosures to you and we will obtain your consent.

1.1.3. Other information may be collected automatically, including IP address. These types of information shall be treated as Personal Information to the extent they can be used to identify you.

1.2. Collection of Personal Information by Third Parties

Some links on our Site may redirect you to third party websites and services that we do not operate. The privacy practices of these websites and services will be governed by their own policies. We make no representation or warranty as to the privacy policies of any third parties, including the providers of third party applications. If you are submitting information to any such third party through our Site or Services, you should review and understand that party's applicable policies, including their privacy policy, before providing your information to the third party. Also note that use of third-party social networking websites, such as Twitter, Facebook, and LinkedIn, are governed by the privacy policies and practices of those websites.

1.3. Aggregate Information Collected

1.3.1. Aggregate Information may be collected when you visit our Site or interact with our Services, independent of any information you voluntarily enter. Additionally, we may use one or more processes to de-identify information that contains Personal Information, such that only Aggregate Information remains. We may collect, use, store, and transfer Aggregate Information without restriction.

1.3.2. For example, when you visit our Site, some information is automatically collected. Such information could include your operating system, the site from which you linked to us ("referring page"), the name of the website you choose to visit immediately after ours (called the "exit page"), information about other websites you have recently visited, browser (software used to browse the internet) type and language, device identifier numbers, your site activity, and the time and date of your visit. Although we do our best to honor the privacy preferences of our visitors, we are not able to respond to Do Not Track signals from your browser at this time.

2. Use of Your Personal Information

2.1. In general, we collect personal information so that we can provide our Site and Services, operate our business, and provide information that you request from us.  This also includes evaluating your eligibility for our Services and projects, conducting research for the purposes of making out Site and Services more efficient and effective, responding to your questions or requests, providing the Site and the Services that you request, and communicating with you about our Site, Services, or our business in general. We may also use your personal information to send you emails and other communication about our company, the Site, our Services, new products, or other similar matters, as well as information about other companies and third parties that we think you may be interested in.

2.2 We also use personal information to prevent, detect, investigate and deter against fraudulent, unauthorized, or illegal activity, and to prevent harm to NAUTILUS or other third parties.

3. Sharing Information with Third Parties

3.1. NAUTILUS does not sell, rent or lease your Personal Information to third parties.

3.2. NAUTILUS may share data with its service providers, as well as trusted partners to help perform statistical analysis, send you email, provide customer support, or to generally assist with providing the Services, or other services that you request. All such third parties are prohibited from using your Personal Information except to provide these services to NAUTILUS.

3.3. NAUTILUS may disclose your Personal Information to affiliates or subsidiaries that require access to your Personal Information for business purposes.

3.4. We may share Personal Information about you as part of a merger or acquisition. If we are involved in a merger, asset sale, financing, liquidation or bankruptcy, or acquisition of all or some portion of our business to another company, we may share your Personal Information with that company before and after the transaction closes. If you apply to subscribe to one of our projects, we may share your Personal Information with investors and other third parties to evaluate your eligibility for such project, and to facilitate your subscription, if approved.

NAUTILUS may disclose your Personal Information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on NAUTILUS or the site; (b) protect and defend the rights or property of NAUTILUS; and/or (c) act under exigent circumstances to protect the personal safety of users of NAUTILUS, or the public.

4. Tracking User Behavior

4.1. NAUTILUS may keep track of the websites and pages our users visit within NAUTILUS, in order to determine what NAUTILUS services are the most popular. This data is used to deliver customizzed content and advertising within NAUTILUS to customers whose behavior indicates that they are interested in a particular subject area.

5. Automatically Collected Information

5.1. Information about your computer hardware and software may be automatically collected by NAUTILUS. This information can include: your IP address, browser type, domain names, access times and referring website addresses. This information is used for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the NAUTILUS website.

6. Use of Cookies

6.1. The NAUTILUS website may use "cookies" to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you and can only be read by a web server in the domain that issued the cookie to you.

8. Security of Your Personal Information

8.1. We strive to take appropriate security measures to protect against unauthorized access to or alteration of your Personal Information. We use reasonable administrative, physical, and technical safeguards to secure the Personal Information you share with us. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. 9.1. Our Site and Services are not directed at children under 13, and we do not knowingly collect Personal Information or other information from children under 13. 10. E-Mail Communcations

10.1. From time to time, NAUTILUS may contact you via email for the purpose of providing announcements, alerts, confirmations, and/or other general communication. In order to improve our Services, we may receive a notification when you open an email from NAUTILUS or click on a link therein.

10.2. If you would like to stop receiving marketing or promotional communications via email from NAUTILUS, you may opt out of such communications by clicking the UNSUBSCRIBE button in the footer of these marketing or promotional emails.

11. Non-US Users

11.1 We are based in the United States and our Site and Services are hosted there. Your Personal Information may be accessed by us or transferred to us in the United States or to our affiliates, business partners, or service providers elsewhere in the world. If you are located outside of the United States, be advised that any Personal Information you provide to us will be transferred to and stored in the United States and that, by submitting information to us, you explicitly authorize its transfer and storage within the United States.
